TERMS OF BUSINESS

DEFINITIONS

For the purpose of this Agreement:

  • The term "Peak Home Services" is the business name under Jasebai Pty Ltd at Peak Family Trust.

  • The term "Householder" means the Householder or Householders who reside in the house or building.

  • The term “Provider Payments” refers to the service providers subsidy payment for services.

  • The term “Gap Payment” refers to out of pocket payments to make up the difference between providers payment and Peak Home Services hourly rate.

  • The term "Website" means the website atwww.peakhomeservices.com.au

AMENDMENTS

  • Peak Home Services reserves the right to amend the terms and conditions of this Agreement, and shall inform the Householder of such changes by posting them to the Website, and/or sending or otherwise providing them to the Householder, not less than thirty (30) days before implementation of such changes.

PROVISION OF SERVICES

  • Peak Home Services shall provide cleaning services to the Householder subject to the terms and conditions of this Agreement, for the hours of work specified under the Householder’s allocated funding or agreed timeframe.

PAYMENT TO PEAK HOME SERVICES

  • The Householder shall sign, and return to Peak Home Services, the Agreement engaging Peak Home Services to provide services and authorising Peak Home Services to claim from their nominated third-party payment provider, payments for all services provided (“the Service Fees”).

  • The Householder will do all things reasonably necessary to facilitate the claim by Peak Home Services for payment for services provided.

  • Failure to pay any payment, gap payments or third party payment,  shall constitute a serious breach and Peak Home Services shall accordingly be able to terminate this Agreement without prejudice.

  • If an invoice is not paid for any reason, we may put your services on hold until we have received payment in full.

  • In the event you default in payment of an invoice, you shall indemnify us from any costs incurred in recovering the outstanding amount, including but not limited to solicitors’ fees.

HOUSEHOLDER OBLIGATIONS

  • The Householder will make their premises available to Peak Home Services in order to provide the cleaning services at the agreed times.

  • The Householder shall provide a safe working environment for the Cleaner at all times.

  • The Householder will ensure that all bins have appropriate liners if bin service is required.

  • Fragile/Breakable/Valuable Items: It is the Householders responsibility to secure/protect/remove all valuable or fragile and high breakable items so that they may not be accidentally misplaced or damaged during provision of the Services (this includes all forms of jewellery).

  • Pets: It is the Householders responsibility to secure any pets they might have, to ensure that they are not able to leave the Property whilst we are providing the Services and that they do not interrupt or impede the provision of the Services by us

  • Children: It is the Householders responsibility to insure children are properly supervised whilst we are providing services and that they do not interrupt or impede the provision of the Services by us.

  • Inability to Access Property: In the event that we are unable to access the Property to perform the Services for any reason whatsoever, including without limitation, no-one being home, no parking available, being turned away or a problem with the keys, we reserve the right to charge for the Service Attendance despite not being able to perform the full scope of the Services.

  • Choose to be home: If the householder chooses to be in the home or building during services and slips on wet floors, trip over electrical cords, spill product or children/pets access chemicals, or any injury is caused due to not vacating the premises while services are being carried out, Peak Home Services will not be liable for any medical expenses, time off work or any other related injury or expense.

PEAK HOME SERVICES OBLIGATIONS

  • Peak Home Services use reasonable care and skill in providing the Cleaning Services.

  • Provision of services: we will perform the Services using safe and proper procedures and practices, including ensuring that our employees are properly trained and supervised and observe all proper safety practices.

  • Cooperation & Respect: We will work with you to provide Services that meet your needs and always treat you with courtesy and respect.

  • Feedback / Issues: We will listen to Your feedback and work with You to resolve any issues that arise quickly to allow the Services to be performed.

  • Insurance: We will at all times have insurance (workers compensation and public liability) that covers the Services provided to you, and if requested, we shall provide you with evidence of the currency of that insurance.

  • Privacy and Confidential Information: We will protect Your privacy and confidential information.

  • Record Keeping: We will maintain clear and accurate records about the Services provided to you whilst this agreement is ongoing.

  • Licenses: We will ensure to hold all relevant licences and permits required in order to allow us to perform the Services.

BUSINESS REQUIREMENTS

  • Peak Home Services first priority is your preferred or agreed day of service, that day is locked in moving forward.  

  • If our clients need to know or confirm the time of your services on your preferred day please call or email us to confirm details.

  • If for any reason Peak Home Services is required to change your service day, eg: Public Holiday’s, cleaner unwell, from your locked in day we will call or email to discuss your options. 

  • Government-funded services bring unique scheduling challenges. Each participant has different approved hours and frequency, some have ongoing services, some only have 3 services and others can have weekly, fortnightly, every 3 weeks or every 4 weeks. Some flexibility with start times on the service day is required. 

  • By using Peak Home Services you have engaged us as a business, not an individual cleaner.  This is crucial for annual leave, personal days and if they move on and spread their wings.

  • We value the wellbeing of both clients and cleaners. If we notice an unhealthy attachment forming, we rotate cleaners to protect both parties. This is part of our well-being policy for your cleaning staff.

  • Clients are not to make scheduling arrangements or changes with services provided directly with the cleaner. Any changes with tasks or day/time of cleaning service needs to come through our office.

  • Clients are not to request a cleaner's personal direct contact details or number.

EXCLUDED SERVICES

  • The Cleaner will not provide the following services:

    • Cleaning of animal faeces or urine;

    • Cleaning of kitty litter, or rooms with overpowering smell of animal urine

    • Nappies;

    • Bodily fluids (vomit, used tissues, cotton buds, period items);

    • Outside of home.  Excluding outdoor kitchens;

    • Moving or picking up personal clothing items (eg: underwear) for cleaning floors and bench tops;

SHORT NOTICE CANCELLATIONS

  • We understand there are times that you will not be able to keep your service visit scheduled with us. However, as we need to manage and schedule our programmed cleaning and maintenance services in advance, we require notice of 2 full business days prior to your scheduled service visit, should you wish to reschedule or cancel (Required Notice). e.g. if your clean is on a Thursday (any time), you have to give us notice on the Monday or earlier to allow for two full business days Tuesday & Wednesday) of notice.

  • In the event that we are not provided the Required Notice, we reserve the right to charge the full service fee of the scheduled service as set out in the Service Pricing section.

CANCELLATION BEFORE FIRST SERVICE

  • Peak Home Services reserves the right to charge a one-hour administration fee where a service agreement has been signed then services are cancelled before the first service commences.

LIABILITY

  • Peak Home Services shall not be liable for:

    • Any loss or damage in excess of the limit of its Public Liability insurance cover or outside the scope of its cover;

    • Collusion or theft of property or possessions by a retained Cleaner. This is a police matter,

  • Peak Home Services shall be liable to the Householder:

    • Where Peak Home Services has not fulfilled its obligations to perform with reasonable care and skill under this Agreement or has failed to perform its obligations at all or to any significant extent;

  • Nothing in this Agreement shall affect the statutory rights of the Householder as a consumer.

DAMAGES AND SERVICE ISSUES

  • In the case of damage or service issues, all feedback needs to be reported on the date the services are provided with photos of the broken item.  We will rectify the problem by crediting you with the item’s present actual cash value up to a limit of $50.00 toward replacement upon payment for the Services.

  • Peak Home Services will not be responsible for the replacement of keys or locksmith fees, unless we, our employees lose the keys provided directly to Peak Home Services for secure storage.

  • Peak Home Services will not be responsible for keys lost from lockboxes outside of our service date and time.

TERMINATION OF AGREEMENT

  • Peak Home Services may terminate the Agreement at any time by giving not less than 14 days notice in writing to the Householder. 

  • The Householder may terminate the Agreement to take effect at any time by giving not less than 14 days notice in writing to Peak Home Services.

  • Where Householder has committed a serious breach of the terms of the Agreement, the Peak Home Services is entitled to terminate the Agreement immediately on written notice.

Serious breaches may include but are not limited to:
1. Abusing or assaulting our employees or contractors (including verbal);
2. Damaging or misusing our equipment and materials;
3. Taking action which is intended to or would reasonably be expected to cause harm to us or our reputation;
4. In the event that our employees or contractors encounter intoxicated Householders or Householders drinking alcohol during services we reserve the right to immediately terminate services. Services will still be charged in full for that day.
5. In the event that our employees or contractors encounter pornography during services we reserve the right to immediately terminate services. Services will still be charged in full for that day.
6. In the event that our employees or contractors find drugs or drug-related paraphernalia during the provision of our services, we reserve the right to immediately terminate this agreement. Such discoveries pose a risk to our employees' safety and termination under these circumstances will take effect immediately without further notice.  Services will still be charged in full for that day.

  • Where Peak Home Services has committed a serious breach of the terms of the Agreement, the Householder is entitled to terminate the Agreement immediately on written notice to Peak Home Services. 

  • For a period of twelve months following termination of the Agreement for any reason, the Householder shall not engage, directly or indirectly, as an employee, contractor, agent or otherwise any Cleaner who has been provided by Peak Home Services to the Householder. If the Householder does so engage a Cleaner in contravention of this Clause, then Peak Home Services shall institute proceedings against the Householder to recover damages and costs. 

PHOTOS AND PRIVACY

  • Your privacy is extremely important to us. We will ensure that all information collected is identified as to what purpose it will be used for. The purposes for which the information is gathered before, after, or at the time of collecting said information. 

  • We will not share collected information with anyone outside Peak Home Services staff.  We will only collect and use personal information solely to fulfil the purposes specified by Peak Home Services, unless we obtain the consent of the individual concerned or as required by law. Also, we will only retain personal information as long as necessary for the fulfilment of the said purpose. The personal data we collect is only relevant to the purposes for which it is to be used. 

  • Photos for property reports are our proof of services. These photos are exclusively for reference purposes as part of your cleaning appointment.  Items we are interested in documenting are, shower bases, stove top, sinks, under tables and mirrors.  They may also include appliances that you wish to be cleaned, for example oven, fridge, cabinets, ceiling fans.  We also document bed sheets that have been changed.  

  • Photos serve as valuable documentation to showcase our work, enhance training materials, and maintain a record of completed tasks. We respect the privacy of our clients and prioritise the protection of their personal information.
    Therefore, we adhere to the following principles:
    - Anonymity and Privacy: All photographs taken will exclude identifying features that could compromise the privacy of clients or individuals present in the premises.
    - Usage: Captured photos may be used in Peak Home Services training materials, internal quality improvement processes, marketing materials, including our website and social media platforms. We commit to using these images responsibly and exclusively for promotional purposes.
    - Opt-Out Option: If a client wishes to refrain from having their service photos used for promotional purposes (website, social media, and advertising material), they may express their preference to Peak HomeServices in writing. We will promptly respect and implement their request.

GENERAL

  • Unless expressly stated otherwise, all representations, rights and obligations entered into by persons named as the Householder, if more than one, are given or entered into jointly and severally by each of those persons. Accordingly Peak Home Services may take action against any one or more of such persons and may release or compromise the liability of any one or more of such persons without affecting the liability of the other(s).

  • If any provision of this Agreement shall be found to be void, invalid or unenforceable, whether by a court of law, agreement of the parties or otherwise, the remainder of this Agreement shall remain in full force and effect notwithstanding any such invalidity, illegality or unenforceability but the provision in question shall be deleted.

  • The Householder agrees to Peak Home Services passing its non-financial personal data to Cleaners who may use it in order to provide services. 

  • Any notice under this Agreement shall be in writing and (with the exception of the Notice of the Right to Cancel) shall be effective on actual or deemed receipt. Notice shall be given by personal service or by first class prepaid mail or by e-mail and shall be addressed to Peak Home Services or to the Householder, as appropriate, at one of the addresses stated overleaf. Either party may, by written notice to the other, change the address to which notices to it may be sent. Deemed receipt shall occur in the case of personal service or e-mail on delivery and in the case of first class prepaid mail on the second working day after posting.

  • Peak Home Services reserves the right to cancel, amend, withdraw or change any promotion, special offer or other marketing offer however made without any prior notice or approval to or from the Householder.
